TERMS AND CONDITIONS OF SALE

1. Scope and Conclusion of Contract (Vertragsschluss)

 

These TCS apply to all sales of digital and physical goods ("Goods") through the "Stitching" website. The presentation of Goods in the shop does not constitute a legally binding offer. A binding offer is made by the customer when placing an order. The contract is concluded when the creator confirms the acceptance of the order via email.

 

2. Prices and Payment

 

Prices are listed in [Currency, e.g., EUR] and are final prices.

• Note for Student Projects: As a non-commercial student project, the creator(s) are likely exempt from VAT collection under the German Small Business Regulation (§ 19 UStG).

3. Right of Withdrawal (Widerrufsrecht)

 

The customer generally has a right of withdrawal of fourteen (14) days.

• Digital Content (Patterns): The right of withdrawal for the supply of digital content (e.g., downloadable patterns) is extinguished if the execution of the contract has begun after the consumer has expressly consented to the execution before the expiry of the withdrawal period, and confirmed his knowledge that he thereby loses his right of withdrawal.

 

4. Warranty (Gewährleistung)

 

The statutory warranty rights (Gewährleistungsrecht) under German law apply. The creator is liable for defects in Goods for two years from delivery.

 

5. Applicable Law and Jurisdiction

 

The law of the Federal Republic of Germany shall apply, to the exclusion of the UN Convention on Contracts for the International Sale of Goods (CISG). The place of jurisdiction for all disputes arising from the contractual relationship is [Specify German City], provided the customer is a merchant or legal entity under public law.
